The Australian Competition and Consumer Commission has instituted Federal Court proceedings against Bupa HI Pty Ltd, seeking $35 million in penalties for unconscionable conduct and misleading consumers about health insurance benefit entitlements over more than five years.
Bupa has admitted to incorrectly rejecting entire claims for hospital treatments involving mixed procedures, where part of the treatment was covered under members' policies and part was not. The conduct affected thousands of consumers between May 2018 and August 2023, with some members left thousands of dollars out of pocket or forced to delay essential medical treatment.
Bupa has already begun compensating affected parties, paying $14.3 million to members, medical providers and hospitals for more than 4,100 impacted claims. The company's systematic failures occurred due to inadequate staff training, unclear assessment procedures, and automated systems programmed to incorrectly reject legitimate claims.
ACCC Chair Gina Cass-Gottlieb emphasized that consumers experienced not only financial harm but also medical risks and distress from cancelled or delayed treatments, highlighting the serious breach of trust by one of Australia's largest health insurers.
Australia's National Disability Insurance Scheme faces an urgent sustainability crisis due to fundamental design flaws that have allowed unlimited access without clear boundaries, according to a new Grattan Institute report released Monday.
Dr. Sam Bennett, the report's co-author and Disability Program Director, warned that the scheme has grown far beyond projected levels since its 2013 launch, with children representing the fastest-growing demographic creating long-term financial commitments that threaten viability. The explosive growth stems from unclear eligibility criteria and the NDIS becoming "the only game in town" for families seeking developmental support services.
The institute proposes a four-step reform plan centered on redirecting existing NDIS funding toward "foundational supports" that would move children with developmental delays out of expensive individualized plans into targeted group programs. Bennett emphasized that systemic design problems, rather than fraud, drive the unsustainable growth, as the current one-size-fits-all approach fails to distinguish between participants needing lifetime support and those requiring time-limited early intervention.
Federal and state governments have struggled to reach funding agreements for alternative supports since negotiations began in December 2023, with the report warning that fundamental restructuring is essential to prevent the scheme from undermining support for its intended beneficiaries.
